Terms of Service

1. Acceptance of Terms

By accessing or using the PeakRank Digital platform at peakrank.co.za, including our SaaS dashboard, APIs, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

PeakRank Digital provides an AI-powered search visibility platform that includes:

• AI citation monitoring across ChatGPT, Perplexity, Gemini, Claude, and Google AI Overviews
• SEO and GEO auditing, reporting, and recommendations
• Keyword tracking and SERP analysis
• Content quality auditing and optimisation tools
• Domain authority analysis
• Managed SEO, GEO, and SEM services (for applicable plans)

3. Account Registration

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must immediately notify us at [email protected] if you become aware of any unauthorised use of your account.

4. Subscription Plans & Payment

The Service is offered on a subscription basis. Plan details, pricing, and features are described on our pricing page. All prices are in the currency displayed at time of purchase and are exclusive of VAT unless otherwise stated.

Subscriptions renew automatically at the end of each billing cycle. You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

5. Free Trial

New users receive a 7-day free trial with full access for the first 4 days, followed by limited access for the remaining 3 days. No credit card is required for the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the full Service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers to access the Service beyond the provided APIs
• Share your account credentials with unauthorised third parties
• Resell, sublicense, or redistribute the Service or its outputs without our written consent
• Submit false, misleading, or infringing content through the platform
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent any rate limits, usage quotas, or technical restrictions

7. Intellectual Property

All intellectual property rights in the Service, including software, designs, logos, trademarks, and content produced by PeakRank Digital, belong to Mind Money Movement (Pty) Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Service for the duration of your subscription.

You retain ownership of the data you upload to the Service. By uploading data, you grant us a limited licence to process that data solely for the purpose of providing the Service to you.

8. Data Protection & Privacy

Your use of the Service is subject to our POPIA Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act, 2013.

You may exercise your data subject rights at any time through our POPIA Forms page.

9. Service Availability & Modifications

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or modifications to improve the Service. We will endeavour to provide reasonable notice of any planned downtime.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Material changes that affect your subscription will be communicated at least 30 days in advance.

10. Limitation of Liability

To the maximum extent permitted by South African law, Mind Money Movement (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

The Service provides SEO and GEO insights and recommendations. We do not guarantee specific search engine rankings, traffic increases, or business outcomes.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mind Money Movement (Pty) Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

Either party may terminate the subscription at any time. You may cancel through your account settings or by emailing [email protected].

We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or fail to pay applicable fees. Upon termination, your right to access the Service ceases immediately. Data retention after cancellation is governed by our Privacy Policy.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to active subscribers via email at least 14 days before taking effect. The latest version will always be available at peakrank.co.za/terms.

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
